it doesn't really matter if JB pays 1mil bail or 2.5k, cuz bail is just to make him temporarily free while while his case is being processed in court. After the verdict is done, bail money is given back to the accused:

bailing isn't justice.

He will still serve his sentence if proven guilty.

You pay a higher taxes percentage if you earn more money in many countries as well. Would you call that class discrimination as well?

It's partly true. It's only the case if they show up for their trial and sentence afterwards. They don't show up, they lose the money.

Progressive tax is class discrimination. But in case of bail, having it higher for rich people is fine imo.

Joey got it. Bail isn't punishment, it's to guarantee the defendant's appearance at trial. JB is unlikely to leave the US permanently because of a DUI therefore very low bail.

There is no point in going any further with this...If what jyushinshuu said is true about bail payment being given back to the accused after a verdict is read then all opinion/ideas about the rich paying higher bail is pointless...They get their money back pending they show up to court..

This post made me cringe. A bail is usually set on the crime you committed not how rich you are, it's also discrimation because you're not being fair to the rich., compared to how you treat others. This is exactly like saying we should make the upper class pay more money for road tolls or charge them an extra tax called the "rich tax" aside all the taxes (federal and state) just because they're rich. It's simply retarded and wrong.


I actually love how people bitch and cry about how the 1% is making all the money and making the poor middle class suffer. The reality is that 75% of our GDP comes from the upper class. Also, I think it's ironic that people get butt hurt if someone said let's make certain ethnic groups like Jews (Tasdik or OP), African American, or any others, pay more for a bail because they're a minority. Your probably going to tell him his "f***ed up" or call him a "racist". Discrimination can be against a race, religion, or class.

It's called marginal tax! As your income rises, the tax you pay also rises.

As a finance student, this frustrates me.

As your income rises, your bail rises as well, is this still class discrimination?

....Even though it wont matter since you get your bail money back anyways.

Let me propose this anyways:
Bail tax.
- You still get bail @ w.e the normal bail amount is, except you pay a tax you don't get back on top of it.
- The tax is based on the income you earn (marginal).
- Bail tax applies to everyone because everyone* has income. Obviously doesn't apply if you don't have any source of income, but does this encourage unemployed people to think they have a lesser consequence because they're not charged a bail tax? No, because how the fuck are they gonna pay for bail with no income? And being unemployed and asking someone to pay for your bail...good luck. If you're running off of welfare and government handouts, your handouts get deducted.

Again, I don't know much about the system; so this is w.e to me LOL

why are you arguing about taxes and shyt, bail amount should be fixed regarding the gravity of the crime that you are accused.

If you don't bail out, you will stay behind bars until the verdict is given.

If the government doesn't return the bail u pay after the verdict is done would be very unfair, what if you're innocent? then u just wasted money paying for some crime that you didn't commit. some sentence requires you to pay fine+imprisonment.

My guess is that the court would Fine+Community service in JB's case.

99% of bailable case, everyone would just pay bail, cuz you will rot behind bars, considering the amount of time in court hearing. From where I live it takes months or even years b4 you the court settle your case.


P.S. why would u add tax in bail? Bail isn't punishment, It's just assurance that you will not run away from your case...

The sixth amendment to the constitution guarantees a speedy trial. In most countries, you can be arrested and sit in jail until your trial, which can be several years before it even starts. In the US, you must be arraigned and offered bail relatively quickly. You will be "free" during the investigation of the crime. If your arraignment is not held relatively closely to your arrest, you will be freed and no charges can be brought. Bail allows the police to make an arrest (and therefore "guarantee an appearance at trial") while still conducting an investigation.

Incidentally, this is why Obama's promise to prosecute Guantanamo prisoners in the US was always a patent lie, obvious to any first year law student. Those prisoners of war were either granted the protections of the constitution or they weren't...and if they were, they must be set free immediately. Honestly, this is bonehead stuff in law school and Obama just threw it out there. Of course, he couldn't follow through on it after the election because he'd be in big trouble if he allowed a bunch of terrorists to be set free onto the streets of NY (which was the inevitable result of this policy).

I guess you only have to post 10% but there are also laws against having excessive bails, so I doubt a trillion is possible unless they take down bill gates or some drug king pin.
