Apple is apparently ramping up its battle to prevent iPhone and iPod owners from jailbreaking their devices.
The company has applied for a patent, titled "Systems and Methods for Identifying Unauthorized Users of an Electronic Device," that covers a series of security measures to automatically protect devices from thieves and other "unauthorized users." Unauthorized users apparently applies to those who engage in jailbreaking, which allows devices to run apps not approved by the company producing the operating system--such as Apple, the main target of such bypasses.

Sounds like it, which is bullshit. Once we pay for it, we should be allowed to use as we like. I don't care if they somehow ban the ipod/iphone from using their services (there's always other ways to get stuff apparently) but trying to make it so that the ipod/iphone can't be used at all? Fuck that.

I don't even jailbreak my ipod. Not sure about the older versions of the touch but with the new 4g i can now set the background picture to whatever i like. But i still hate the fact that apple only allow you to use itunes to sync stuff into their products.

There are plenty of itunes alternatives for managing the music on your device. Also you are missing out big time by not jailbreaking your ipod.
