ELYRIA, Ohio (Jan. 13) - Although a teenager's obsession with a violent video game may have warped his sense of reality, the boy is guilty of murdering his mother and wounding his father after they took "Halo 3" away from him, a judge ruled Monday.
"I firmly believe that Daniel Petric had no idea at the time he hatched this plot that if he killed his parents they would be dead forever," Lorain County Common Pleas Judge James Burge said.


Insanity Defense Rejected



Rejecting an insanity defense, a judge in Elyria, Ohio, ruled Monday that a 17-year-old was guilty of fatally shooting his mother and wounding his father after they took away his "Halo 3" video game. Daniel Petric, here in 2007, faces the possibility of being sentenced to life without parole.



Nonetheless, Burge rejected the defense attorneys' argument that Petric, 17, was not guilty by reason of insanity.
The defense didn't contest that Petric shot his parents in October 2007 after they took the game away from him, but insisted that the teen's youth and addiction made him less responsible.
Petric may have been addicted, but the evidence also showed he planned the crime for weeks, said Burge, who found the teenager guilty of aggravated murder, attempted aggravated murder and other charges.
Tried as an adult, Petric faces a maximum possible penalty of life in prison without parole. The judge didn't set a sentencing date.
The teen's mother, Susan Petric, 43, died of a gunshot wound to the head. Her husband, Mark Petric, a minister at New Life Assembly of God in Wellington, also was shot in the head but survived.
After the verdict was announced, Petric turned to look at his father seated behind him in the courtroom. Mark Petric, who previously said he has forgiven his son, gave an encouraging nod.
Mark Petric and other relatives left the court without comment.
Prosecutors said Petric planned to kill his parents because he was angry that his father would not allow him to play the video game, in which players shoot alien monsters that have taken over the Earth.
On the night of the shooting, Petric used his father's key to open a lockbox and remove a 9 mm handgun and the game.
Mark Petric testified that his son came into the room and asked: "Would you guys close your eyes? I have a surprise for you." He testified that he expected a pleasant surprise. Then his head went numb from the gunshot.
Deputy prosecuting attorney Anthony Cillo argued during the trial that the teenager had planned to make it appear to be a murder-suicide by putting the gun in his father's hand.
Defense Attorney James Kersey said that when the teenager fled the grisly scene, he only took one item with him: the "Halo 3" game.
Bungie LLC, once part of Microsoft, developed the Xbox 360-exclusive Halo 3, and Microsoft owns the game's intellectual property. Microsoft declined to comment beyond a statement: "We are aware of the situation and it is a tragic case."

That's just as bad as the kid who ran away from home when his dad took his xbox away. Turned up dead some distance from home, where he had just frozen to death in the Canadian winter... From what I understand, the dad is completely guilt-ridden, which sucks cause I feel more for him than the kid.

Kids these days are too addicted to games, and it has gotten to the point where they take such drastic actions without thinking about the overall consequences. I mean... 10 years from now, that guy who killed for Halo 3 will be sitting in a jail cell asking himself if it was really worth it.

Lol what a load of fallacious bullshit. The game itself is not the source of the kid's aggressively murderous behavior. No matter what kind of obsession that kid is into, whether it be video games, a tv show, collecting insects, or whatnot, he still would've done the same thing if it was taken away from him because it probably was the only thing that kept him tamed.

Oh noes! It must be all over the news, since every human being needs to be informed about the dangerous hell spawns that are videogames.
When people kill each other because of a can of beer, nobody cares that much.

I always wonder why they first point the finger to a videogame, instead of at the gun they somehow could get into their hands to kill someone with.
If games really were the cause of people killing each other, it'd happen a lot more.

A kid kills someone, and everyone goes blaming a gaming company, because 'that kid played video games'. He ate peanut butter sandwiches too, do you hear anyone blaming the peanut butter companies?

Obviously because the subliminal messaging inside games. See, Bungie is telling us that aliens = our parents, and that our parents are trying to take over the Earth and kill us. Not directly, but the message is there.

Of course games are not the source of ones aggressive behaviour, they just stimulate a person that is wicked by nature. Nobody with a sane mind would kill his parents because they took away a game from them. The game itself cannot distort a child's mind to the point where it starts killing, I'm sure of it. People get killed over parking, little fight and other stuff but nobody gives a crap. When somebody plays a game and kills someone, the companies get blamed first.

Well when you think about it, whether it be video games or something else, we all have things in which we rely on to get us through life. For example, for me its the internet. When i get home after a long day i like to be able to just chill out and talk to some people, read the news or read some comics on the net. Now when my net is down i admit i dont go out and kill people because of it, but it does leave me annoyed at times. Now if someone reliance on their "things" reaches the point where without it they can not function, you can start to understand why he did it. It's not the game that made him kill, rather his reliance on a single source of comfort in life. It's a sad sad story to read.

Definitely not the games fault, it's not even because of the game he did it, it's because they took it away, so you see, no games = murder~ lol.

But really, hes not right, he obviously would of done the same thing if it was like ciggarettes and they got taken away or somethin.
