Joymax hasn't broken any laws yet. If they do break a law then the full force of the California Legislature will come down hard (if necessary), but that is highly unlikely. Since they have a base in the United States they have to abide by American Laws, so the "they're in Korea" doesn't apply here. What does apply, though, is that their ToS has been broken. Funny thing, The one thing Joymax did well was writing that ToS. They wrote in such a way, that 1]The Common Man won't understand it, 2]They're (Joymax) is completely protected, and 3]They can break as many rules as they want (in their ToS) without being reprimanded by the law. Most Agreements have a "If any part of this (insert name) is broken, the agreement between both parties becomes void." In this case the community and Joymax, surprise, surprise: Joymax doesn't have this clause, and therefore their ToS is still intact. (Despite the minor infraction, that (in normal situations) would've rendered the ToS null&void.) *Sigh, a man can dream. Anyhoo, Joymax hasn't broken any rules.

@Grimm, if the US tries to control the world, it (the action of ruling) would lead to it's (the USA's) downfall.

#1, the game IS free. The purchasing of Silk IS optional!

False advertising would be, 'Come play our free game' - You go to play the 'free' game, then when you actually go to load the game up, it says you need to put your credit card info in and pay a fee of $20. That would be false advertising / false luring.

BladeSkillz wrote:In the United States there is a law that prohibits companies from using a Bait and Switch tactic to hook in customers, providing them with the false idea that they will get a good deal on an item that is no longer in stock.

An example is say a 52'' plasma screen TV on sale 75% off but there are only 2 in stock and get sold immediately. People come in the rest of the day ready to purchase the TV but since there are no more they end up buying something else since they feel they came for nothing. The store owner intentionally only has 2 in stock so that he doesn't lose money and at the same time makes profit off of the people that came in wanting the TV but decided not to leave empty handed. THIS IS ILLEGAL!

This example can be applied to what Joymax is doing. They offer a "free" game to attract people but offer very limited slots on their servers so that you are forced to pay money to log in. It's a Bait and Switch tactic used to lure customers in and end up paying for what should have been free. It's very similar to false advertising.

I believe when its a free game there is no law prohibiting how they choose to run it. If you don't like it theres more online games, but trust me i know how you feel on the slots situation its annoying when someone knew wants to try out the game and cant even log in :banghead:

I would like to respond to a few comments posted.

1. Just because Joymax is a company based in Korea does not mean that they can conduct illegal business tactics in the United States. They hold an office in California and they must abide by US law.

2. Although you may disagree, Joymax offers a "free" game but their real intention is for you to pay in order to log in. They are indeed pulling a bait and switch tactic because if you truly want to be able to play freely whenever you want you MUST purchase, at a minimum, a $15 premium ticket every 28 days.

3. I never stated I wanted to sue Joymax company and I certainly don't have the intention because such a suit would never result in a settlement and would only waste a courts time. I am merely bringing to your attention that Joymax illustrates very poor business conduct (which you all already know anyway) to such an extent that it violates business practice laws in the United States.

4. I am not 15 years old, I am 19. I am a junior in the University of Central Florida and I am an accounting major and I am pursuing a minor in legal studies. You however (and I am referring to the person making the age comment) responded to my post in an insulting manner and you make yourself look childish.

Actually, companies do that all the time. Like Wal-Marts blitz sale, everything is marked down but say on TVs and laptops they have say 5 of them but many high priced ones. Plus good luck sueing since they aren't based in America. Really dont think you have the money for that

I didnt see the relation with sro here. If u dont like sro, just quit it. No one force u to buy a premium ticket. It's the bots that make the servers crowded, not JM. Go sue them.
As for those who decided not to leave empty handed are just dumb ass too. No one force them to buy anything and there is no harm to not buy anything.

Your wrong... nowhere in the ToS does it say u can get in when ever u want... it just says its a free game which it is... how long it takes u to enter the game is not the issue. it just so happens u can ensure ur entry indefinitley by buying a PT

3. I never stated I wanted to sue Joymax company and I certainly don't have the intention because such a suit would never result in a settlement and would only waste a courts time. I am merely bringing to your attention that Joymax illustrates very poor business conduct (which you all already know anyway) to such an extent that it violates business practice laws in the United States.

it doesent violate the law once again its a free game... and yes Joymax has a poor business ethic but they dont need to care about the customers when there makin the money they do... also they have a great game which some people find difficult to walk away from (including myself i quit 3 times... not worked yet)

4. I am not 15 years old, I am 19. I am a junior in the University of Central Florida and I am an accounting major and I am pursuing a minor in legal studies. hey m8 im 18 i am childish deal with it (plz see username) and if ur so high an might why are u talking complete shit on a forum without doing proper research... Barotix has a very informative thread in which he shows the flaws from Joymax's ToS altough they changed there ToS do make themselve not liable... which is perfectly legal as they had a clause in the Terms which stated that they could change the ToS without the permission of the applicant as long as they inform the applicant thereafter... which has been done.

and i responded in an insulting manner which makes me look childish... ok? so when adults fight they dont insult each other... wow someone has clearly never been to a pub...

ToS or not, a company still has to abide by the laws of each country it conducts business in. Now if a company doesn't have an office within that country it may be difficult to get a judgement enforced, but in this case Joymax has an office within the US. That means that if Joymax is violating American law it can be sued, and it can be penalized by a judge. I'm not going to comment on whether I believe Joymax is violating American law, since I'm not familiar with these aspects of American law.
