take the border out, make new layer color all white, just cut out what you don't want in the sig, and set it to color dodge or overlay, or i guess w\e u want.. simple but effective for that kind of sig..

i know there is a sig request forum, i was simply asking if i can use a pic that is similar so then there is no "you coppied my pic" type of thing

The way you worded it seemed like you where requesting someone to make you a sig using that image. Also fyi the larger image is posted somewhere in the " CopyCat" thread.

You can. It's a non-copyrighted stock and been used in many stock packs.
