If your lvl 41 wearing a 42 weapon, its like its in your inventory, therefore it will drop. At least it did during the 60 cap.

Note a shield isn't a weapon verf. From my understanding an equipped weapon will not dropped but this doesn't include shields. If someone wants to make a video proving otherwise, be my guest.
