a question about unique drops

when the unique is dead, every1 is able to pick up the items? or only the guy who killed it. cuz once i came where they killed TG i could pick the items.

From my experience im not sure who gets to it first, because its possible for someone that does the most damage would NOT get the kill because all the dmg in the party is added together on uniques and the one who gets the killed did the most damage IN the party (believe me this has happend to me on more than one occasion). But i know theres still a 20 second wait on unique drops but im a bit undecided on whether its the person who got the kill or the one who does the most dmg that gets the drop.
