Attacking lower level (on job)

Can eg a hunter attack a lower level thief without any provocation ie an attack from the thief? Is there any penalty resulting from attacking a lower level thief?TIA
2H Sword / cleric on Pluto. Level 82 and stopped
Wizzard / Cleric on Pluto. Level 46 and very slowly creeping towards the next level
