I'm pretty sure joymax changed there ToS so that you can't chargeback or you don't get your money back, I have heard people on here saying that as well that they didn't get there money..

That doesn't make any sense. Not surprising, because most people don't use the terminology correctly. A chargeback is the result of a dispute. You dispute a transaction, and if the CC rules in your favor, then a chargeback is performed. If you didn't get your money back, then no chargeback was performed. This in turn means that your dispute was unsuccessful. In this case, the merchant (Joymax in this case) never lost its money, and therefore your account cannot be banned.

U can charge back, but u end up losing your account with a 100 years ban.
Then, u will get your money back after you escalated your claim.

Its even lamer to even pay them in the first place -.- *regret regret regret regret regret regret*!

U get your money back as long as you escalate it to a claim.
And you do not get your account banned initially.
Your account is banned once you escalated it to a claim.

The process is like this

1) You charge back entering a reason, for example "JM SCAMMED ME"
2) Then, JM is given a period of time to defend/respond to that.
3) You escalate the charge back to a claim
4) You get your money back, if you use a CC, you will have a credit balance on your next month statement.

Now, If i remember correctly, you can only escalate your charge back to a claim after 7 days from your charge back date. You have to escalate it to a claim within 31 days or Paypal will take it that the matter has been resolved between you and JM. Thus, no monies will be refunded.

To clear something up, speaking as somebody who did chargeback, this is exactly what happens:

Day 1: You file a dispute with Paypal and escolate that to a claim. Your account will be banned almost instantly after.
Day 2: Paypal will review your case and decide if you deserve a refund. This can take upto a month. Mine took a little over 2 weeks.
Day 16: You will recieve an email, like i did, like this:

Dear XXX,

We have concluded our investigation into your case:

Case ID: PP-xxx-xxx-xx6
Transaction Date: 3 Mar 2009
Transaction Amount: -$50.00 USD
Seller's Email: paypro@silkroadonline.net
Seller's Name: Joymax Entertainment

Unfortunately, we were unable to resolve this claim in your favour because
the item purchased was virtual or intangible. As a result, we have not
taken any action against the seller at this time but we have noted your
dissatisfaction in the seller's record for future reference.

Day 17: Your account will be unbanned.
