Does that mean that if I believe that Bank of America doesn't care about me, I should not care about them and that I should sell my checking account to someone, or I should buy someone else's checking account from them? Even if BOA specifically says it is against their rules? After all, BOA 'doesn't care about me' so why should I care about their rules?

Caring about what JM wants is irrelevant. If you do something that is against Joymax's TOS, and they punish you (even indirectly) for it, then it's your loss.
