I got a letter like this a few months back lol.
It's legal, IP's connected to a torret is viewable by anyone else connected to it. So chances are some member from the MPAA was browsing torrents and noticed your IP. Guessing you're on Time Warner? They started sending these pink notices in waves.

EDIT: They haven't gone through your PC, they are simply saying that clearing this content from your PC is a good idea cuz if the MPAA member has a warrant to search your PC and finds these files, you sir, are fucked.

I used to get them all the time for downloading movies. The part that got me on the letter was something like:

"although we can take no legal action, we strongly advise you delete all..." blah blah blah

Big deal.

Your ISP isn't running some scan on your computer to see which files are legit and which aren't. The location of your files is irrelevant. And for your next question, no, renaming a ripped movie file to something else wont help either.

Every piece of information you retrieve from the internet has to pass through your ISP in order to get to you. If your ISP has reason to believe you're getting media illegally, they will call you out on it. They can assume the legality of the files by checking which sources you're getting them from. For example, if you download movies though public torrent trackers (like TPB), it's possible that whatever you downloaded was a fake tracker created by the MPAA or RIAA (or tracked by them) as a sort of honeypot to gather information on people downloading files illegally. The IPs are then matched to ISPs and they match those IPs to accounts and notify the account owners of their wrongdoing.

Just because pirating is socially acceptable does not mean it doesn't carry consequences. If you don't understand those consequences, I would suggest you refrain from pirating and educate yourself first.

If you really want go keep torrenting illegal stuff then use BTGuard: http://btguard.com/. It costs money but I'm sure you are saving more than enough by downloading.

Get something that gets you stuff for free by getting it free from the same process

On topic.

If they call you out on it you can say you don't password protect your wireless router. (Not proven but something someone said once.)

I myself don't pirate stuff. I have no need to. I don't buy movies and I buy games that are on sale unless I really want the game.

From the video I watched you have to login in order for it to work, so I don't think downloading will really help at all. Plus if you fuck over the people that are trying to help you from getting fucked over, what's stopping them from fucking you over?

Part of the letter TWC sends is an agreement that you will password protect yourself and that you are from then on accountable for the downloads on your account.

Also, this argument is void because your own ignorance and lack of personal responsibility doesn't dismiss the fact that you were passively allowing illegal software to be downloaded via your network. You are held accountable for the network access and therefore any traffic.
