He was still visible to the general public (neighbors.) That he happened to be seen so early in the morning is actually just bad luck for him.

Yes, but lets say if i lived on my own little slice of the "American Dream Home" complete with White Picket fence out-front..
and i happen, for wtvr reason, to walk out into my backyard in the Nude... maybe i was working on my FULL body tan..
Your saying i could get arrested for Indecent exposure? When i'm doing it in what little "privacy" a person really has, and it's my neighbors that chose to abuse my privacy? (Technically)

A few months back someone posted an article about a man that was charged and found guilty of indecent exposure when a woman and her son went for an early morning walk and they could see him naked THROUGH HIS WINDOW in his kitchen.
I mean really wtf, can't be naked in your own damn house in the morning.

The only time it would be ok, is if they specifically had to try to look to see you while naked. So lets say you have an 8 foot high picket fence around your property, and your neighbor puts a ladder right next to it and purposely looks over it at you... Pretty sure you wouldn't get in trouble then.

But seriously let's say that a chick is just lying outside in her backyard, and she has one of these:
or
N she decides that it's the middle of summer, it's hot, sunny, she is in the middle of her own backyard, with a fence all around, so she takes off her top, and starts sunbathing in the nude...
Now, one of the neighbors, luckily from the spare room or wtvr has a window on the 2nd floor that because of the tree that the other neighbor just trimmed lets them look into the sunbather's back yard.
Unfortunately, it was not the teenage son, or husband who discovered this window, but the obese, and we are talking about i'im.the.typical.obese.woman.you.find.in.walmart.and.i.think.my.husband.doesnt.like.me.anymore type of woman who discovers it. So, because she sees this fox of a woman sunbathing in the nude, and get's overcome with a jealous rage.. your saying she can call the cops and complain that the sunbather should be arrested for Indecent exposure?

Then, it probably depends on the jury. I know that if I were in that jury, I'd vote not guilty, but some lawyers would love to spin it the other way if they can.
